What is Scamwatcher?

Scamwatcher is a community site that allows people to report and learn about scams. More than a million users use it every month.

Who writes the content on Scamwatcher?

Scam reports and comments are put online by users without any moderation being carried out (same principle as on social networks: Facebook, Twitter, Instagram…).

Does the Scamwatcher team have knowledge of the content posted online?

No !

Every day, hundreds of reports and comments are written. The Scamwatcher team does not control the information posted online and has no knowledge of the content.

Therefore, any imprecise request that suggests the team has knowledge of content will be ignored.

How to report a scam

After filling in the form, an email is sent to the author to click on a validation link. This action allows the report to be put online.

How to modify your own scam report?

It is not necessary to have an account to file an alert, just an email address. Sometimes, after an alert has been posted online, people want to modify or delete it (typing error,…).

In this case, nothing could be easier! You just have to create an account with the same email address as the one used to put the alert online. Then, after registration and connection, new features will be visible on the alert in question.

How to edit your own comment

In the same way as for modifying or deleting a comment, you just have to create an account with the same email address that was given when you posted your comment.

Then, after registration and connection, new features will be visible on the comment in question (red cross to delete, green pencil to modify).

Who is responsible for the content posted online?

The Internet users are responsible for their writings.

What to do in case of illegal content ?

As indicated previously, there is no moderation a priori of the contents put on line. If illicit content is observed, you must contact the author through the comments to ask for its removal or modification.

If nothing is done after a reasonable time, you can contact the Scamwatcher team by requesting a removal of content by indicating :

  • Your identity
    • If you are a natural person : your name, first name, profession, address, nationality, date and place of birth.
    • If you represent a legal entity: its form, its name, its registered office and the body that legally represents it.
  • If you represent an Internet site, please indicate the URL of your legal notice. The presence of the name of the director of publication (mandatory in France in particular) will allow us to verify your identity.
  • The description of the litigious facts and their precise location (indicate precisely the writings, not only the page or pages). As a reminder, the pages of reports are of type www.scamwatcher.com/scam/view/xxxx
  • The reasons why the content must be removed, including the mention of legal provisions (articles of law) and justifications of facts.
  • A copy of the correspondence addressed to the author or publisher of the offending information or activity requesting its discontinuation, removal or modification, or the justification that the author or publisher could not be contacted.

I would like to get the identifying information of a poster, is this possible?

No.

In accordance with the GDPR, Scamwatcher protects the personal information of reporters. Only the judicial authorities can obtain this information through, for example, a judicial requisition.

  • By registered mail : If your request requires a high degree of traceability, this is the way to prioritize. No answer will be given if the information requested is on this page. In the same way, in case of threat or aggressiveness, a mail blocking can be done.

Which private data are collected? Why?

We keep the email address you provide us with in order to prevent from any abuse of our websites and to allow authentication.

The IP address used during your browsing on our websites is saved during 1 year to compy with the french regulation.

What is the posting policy?

The information published on the Scamwatcher site is not subject to any prior control and does not offer any compensation. The publication is instantaneous after validation by the user and the maximum retention period is 10 years.

Which law is applicable and which is the competent jurisdiction in case of dispute?

The legal rules applicable to the contents and data transmissions on and around the site are determined by French law. In case of dispute, which could not be settled amicably, only the French courts of the jurisdiction of the Court of Appeal of Reims are competent.
